Payment providers may process your personal information as independent data controllers for some purposes and their own privacy policies will apply to that processing.

We may record:

  • whether you have agreed to receive marketing;
  • your marketing preferences;
  • when and how those preferences were obtained;
  • whether you have unsubscribed or objected to marketing;
  • marketing emails sent to you;
  • whether emails have been delivered or interacted with, where permitted; and
  • interactions with our advertising and marketing campaigns.

We may retain suppression information where necessary to ensure that we respect a request not to receive further marketing.

3. How We Collect Personal Information

4. How and Why We Use Your Personal Information

UK data protection law requires us to have a lawful basis for processing personal information.

Depending upon the particular processing, we rely upon one or more of the following bases.

Performance of a contract

We process personal information where necessary to enter into or perform our contract with you, including to:

  • process and fulfil orders;
  • take and administer payment;
  • arrange delivery;
  • provide order and dispatch information;
  • administer returns, cancellations and refunds;
  • provide customer service relating to an order; and
  • administer relevant aspects of your customer account.

Legitimate interests

We process personal information where this is necessary for our legitimate business interests, provided those interests are not overridden by your rights and interests.

These interests may include:

  • operating and improving our business and website;
  • providing customer service;
  • maintaining appropriate business records;
  • protecting our business, customers and website against fraud and misuse;
  • securing our systems;
  • understanding the performance of our business;
  • managing stock, demand and logistics;
  • handling complaints and disputes;
  • establishing, exercising or defending legal claims;
  • understanding how customers use our services where the processing is permitted without consent; and
  • marketing our own similar products to existing customers where permitted by applicable data protection and electronic marketing law.

Where cookies or similar technologies require consent, we will not rely on legitimate interests to avoid that consent requirement.

Consent

We rely on your consent where required, including for certain:

  • marketing communications;
  • analytics technologies;
  • advertising cookies, pixels and similar technologies;
  • personalised advertising activities; and
  • other non-essential tracking technologies.

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.

Legal obligations

We process information where necessary to comply with legal obligations, including those relating to:

  • tax and accounting;
  • consumer protection;
  • fraud and financial crime;
  • responding to lawful requests from courts, regulators and law-enforcement authorities; and
  • exercising and responding to data protection rights.

5. Our Relationship with Shopify

Our online store and ecommerce services are hosted by Shopify. Shopify collects and processes personal information about your access to and use of our website and services in order to provide and improve those services.

Information that you submit through our store may be transmitted to and shared with Shopify and service providers used by Shopify, including organisations that may be located outside the United Kingdom.

We have enabled Shopify Network Intelligence and use certain Shopify Enhanced Services. These features may use information obtained from your interactions with our store together with information from your interactions with Shopify and other participating merchants.

This processing may be used to provide services such as:

  • more personalised shopping experiences;
  • product and service recommendations;
  • advertising and marketing personalisation;
  • advertising measurement and attribution;
  • improvements to Shopify products and services;
  • fraud prevention and security; and
  • other Enhanced Services provided through Shopify.

For processing undertaken by Shopify for these Enhanced Services, Shopify may be responsible for that processing, including responding to requests to exercise rights relating to Shopify's use of personal information for those purposes.

Where required by UK law, we obtain your consent before information from non-essential cookies or similar technologies is used for advertising, personalisation or related purposes. You can withdraw or change your cookie choices using the cookie/privacy controls provided on our website.

To learn more about how Shopify uses your personal information and the rights that may apply to Shopify's processing, please read the Shopify Consumer Privacy Policy.

You can also use the Shopify Privacy Portal to exercise certain rights or manage privacy choices relating to information processed by Shopify.

6. Payments

We offer payment methods including:

  • Shopify Payments, including supported credit and debit cards;
  • PayPal;
  • Apple Pay;
  • Google Pay;
  • Klarna;
  • Clearpay;
  • Shop Pay; and
  • Amazon Pay.

When you choose a payment method, relevant personal information is provided to the payment provider to process the transaction, prevent fraud, comply with legal requirements and provide the selected payment service.

The provider may process information under its own privacy policy and, in some circumstances, as an independent data controller.

7. Delivery of Your Order

To fulfil your order, we may share the personal information necessary to arrange delivery with our delivery providers.

Our delivery providers currently include Royal Mail, Parcelforce and APC.

Information provided may include your:

  • name;
  • delivery address;
  • telephone number;
  • email address;
  • order or parcel reference; and
  • other information reasonably necessary to deliver and track your order.

We only provide information reasonably required for delivery and associated services.

8. Email and Customer Communications

We use Spoks to help us manage transactional/service communications and email marketing.

Service and transactional communications

We may send communications necessary to administer your order or relationship with us, including:

  • order confirmations;
  • payment-related communications;
  • dispatch and delivery information;
  • cancellation and refund information;
  • account and security communications; and
  • responses to customer-service enquiries.

These communications are not treated as marketing merely because they are sent electronically. However, adding promotional content to a communication may cause that content or communication to constitute direct marketing.

Marketing communications

We may send you information about products, offers, promotions and other Home Flair Decor news where:

  • you have consented to receive it; or
  • we are otherwise permitted to do so under applicable electronic marketing law, including the products and services “soft opt-in” where all of its requirements are satisfied.

Where we rely on the products and services soft opt-in, this applies only where the relevant legal requirements are met, including that we obtained your contact details in connection with a sale or negotiation for a sale of our products or services, the marketing concerns our own similar products or services, and you were given an appropriate opportunity to opt out when your details were collected and in each subsequent marketing communication.

You can unsubscribe from email marketing at any time by using the unsubscribe facility contained in our marketing emails or by contacting us.

9. Sample Purchase Follow-Ups

If you purchase a wallpaper sample or another sample product from us, we may use information about that purchase to send you relevant follow-up communications concerning the corresponding product or similar Home Flair Decor products.

For example, following the purchase of a wallpaper sample, we may contact you about purchasing the corresponding full roll.

Where such a communication promotes a subsequent purchase, we treat it as direct marketing for data protection and electronic marketing purposes, even where the technology used to send the communication categorises it differently.

We will send such marketing only where permitted by applicable law, including where you have consented or where the products and services soft opt-in applies.

Marketing communications will provide an appropriate method of opting out.

10. Abandoned Baskets and Checkouts

If you provide your contact details while shopping or during checkout but do not complete your purchase, we may use those details to remind you about products left in your basket or an incomplete checkout.

Where an abandoned-basket or checkout communication encourages you to complete a purchase, we treat that communication as direct marketing and send it only where permitted by applicable electronic marketing law.

You may opt out of such marketing communications using the unsubscribe facility provided.

11. Analytics and Advertising

Subject to your cookie and privacy choices where required, we use services including:

  • Google Analytics 4;
  • Google Ads;
  • Google Merchant Center; and
  • Meta/Facebook Pixel.

These services help us understand how our website is used, measure advertising performance, advertise our products and, where permitted, provide or measure more relevant advertising.

These technologies may collect information about your device, browser, IP address, website activity, interactions with advertisements and other online identifiers.

Google, Meta and other relevant providers may process information for their own purposes in accordance with their respective privacy terms.

Non-essential analytics and advertising technologies are subject to the consent requirements described in our Cookie Policy and our website's cookie/privacy controls.

You can change your consent choices through the cookie/privacy controls available on our website.

12. WhatsApp, Messaging and Customer Support

We provide website messaging functionality, including Shopify Messaging and a WhatsApp integration provided through Elfsight.

If you choose to communicate with us using these services, information you provide may be processed by the relevant technology provider and, where applicable, WhatsApp/Meta.

Those providers may also process information in accordance with their own privacy policies.

You are not required to use WhatsApp to contact us. You can contact us using the alternative contact details provided in this policy.

13. Shipping and Other Shopify Applications

We use ShipMagic to help us determine and provide appropriate delivery options and rates.

Information relating to your basket, products and delivery destination may be processed as necessary to provide the appropriate delivery options.

We may install or change applications and service providers from time to time. Where a change materially affects how we process personal information, we will update this Privacy Policy and, where necessary, our consent arrangements.

14. Fraud Prevention and Security

We may process information to identify, investigate and prevent suspected fraud, misuse, security incidents and other unlawful activity.

This may include information about:

  • orders and attempted orders;
  • payment status and risk indicators;
  • billing and delivery addresses;
  • IP addresses and devices;
  • transaction patterns; and
  • information supplied by payment providers and fraud-prevention systems.

We may delay, refuse or cancel an order where we reasonably consider this necessary to protect our legitimate interests, our customers, payment providers or others against suspected fraud or misuse.

Where applicable, information may also be processed to comply with legal obligations.

15. Who We Share Personal Information With

We do not sell customer contact information to third parties for them to send their own direct marketing.

We may share personal information where necessary with categories of recipients including:

  • Shopify and providers of our ecommerce infrastructure;
  • payment processors and payment-method providers;
  • Royal Mail, Parcelforce, APC and other delivery providers where necessary;
  • Spoks and communication service providers;
  • ShipMagic and other website/application providers;
  • analytics and advertising providers including Google and Meta, subject to applicable consent requirements;
  • Elfsight, WhatsApp/Meta and messaging providers where you use those services;
  • professional advisers such as accountants, solicitors and insurers where necessary;
  • IT, hosting, security and technical service providers;
  • fraud-prevention and payment-security providers;
  • regulators, courts, law-enforcement authorities and other public bodies where disclosure is required or permitted by law; and
  • a purchaser, prospective purchaser or adviser in connection with a sale, restructuring or transfer of all or part of our business, subject to appropriate safeguards.

We require service providers processing information on our behalf to handle personal information appropriately and in accordance with applicable data protection requirements.

16. International Transfers

Some of our service providers operate internationally. As a result, personal information may be transferred to, accessed from or processed in countries outside the United Kingdom.

Where UK data protection law requires safeguards for an international transfer, we take appropriate steps to ensure those safeguards are in place.

Depending upon the circumstances, these may include:

  • transfers to countries covered by UK adequacy regulations;
  • use of approved contractual safeguards such as the UK International Data Transfer Agreement or the UK Addendum to approved standard contractual clauses; or
  • another transfer mechanism permitted by UK data protection law.

Where appropriate, we also consider whether additional technical, organisational or contractual measures are required.

17. Cookies and Similar Technologies

Our website uses cookies, pixels and similar technologies.

Some are necessary for the website, checkout, security and other services to function. Others are used for purposes such as analytics, advertising, personalisation and measuring marketing performance.

Where UK law requires consent for a cookie or similar technology, we will ask for that consent before using it.

You can accept, reject or manage non-essential technologies using the cookie/privacy controls provided on our website.

For further information about the technologies we use and your choices, please read our Cookie Policy.

18. How Long We Keep Personal Information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including to meet legal, accounting, tax, regulatory and reporting requirements and to establish, exercise or defend legal claims.

Different categories of information may therefore be retained for different periods.

For example:

  • order, transaction and accounting information may be retained for the period necessary to comply with tax, accounting and other legal requirements and to deal with contractual or legal claims;
  • customer account information may be retained while your account remains active and for an appropriate period afterwards, subject to information we need to retain for other lawful purposes;
  • customer-service enquiries and complaints are retained for an appropriate period having regard to the nature of the enquiry and the possibility of a subsequent dispute or claim;
  • marketing information is retained while we have an appropriate basis to market to you. If you unsubscribe or object, we may retain limited suppression information so that we can honour your preference;
  • cookie and consent records may be retained as necessary to demonstrate and manage your privacy choices;
  • abandoned basket and checkout information is retained only for an appropriate period having regard to its purpose and any other lawful reason for which the information needs to be retained; and
  • information relevant to fraud, disputes or legal claims may be retained for longer where reasonably necessary to investigate an issue or establish, exercise or defend legal rights.

We may delete or anonymise information when we no longer need to retain it.

19. Keeping Your Information Secure

We take appropriate technical and organisational measures designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

No internet-based service can guarantee absolute security. We therefore keep our security arrangements under review and work with service providers that provide appropriate safeguards for the information they process.

20. Your Data Protection Rights

Depending upon the circumstances, UK data protection law gives you rights in relation to your personal information.

Right of access

You can ask whether we process your personal information and request a copy of the personal information we hold about you.

Right to rectification

If you object to direct marketing, we will stop using your personal information for that purpose.

Right to withdraw consent

Where we rely upon your consent, you may withdraw it at any time. This does not affect processing lawfully carried out before consent was withdrawn.

Rights relating to automated decision-making

You may have rights in relation to certain decisions made solely by automated means where those decisions produce legal effects or similarly significantly affect you.

We use automated systems and risk indicators in connection with areas such as payment processing, fraud prevention, advertising and personalisation. This does not necessarily mean that we carry out solely automated decision-making of the type giving rise to specific rights under UK data protection law.

If you have concerns about a decision affecting you, please contact us.
